Terms of Use for the Learning Management System (“LMS”) Academy+ by FR L'Osteria SE
1. Scope
These Terms of Use apply to the use of the Learning Management System “Academy+” by FR L'Osteria SE (hereinafter referred to as the “Operator”) by:

Employees of FR L'Osteria SE
•
Employees of joint venture partners
•
Employees of franchise partners
•
External service providers (e.g., freelancers, temporary workers, or similar employment relationships) if they require access to training content
The LMS is used for internal training, documentation of training, and personal development of users. Use of the LMS requires acceptance of these Terms of Use and the Privacy Policy. Users must actively accept the Terms of Use upon first login.
2. Operator and Service Provider
The LMS is provided by Cornerstone OnDemand Inc. (hereinafter referred to as “Cornerstone”) as a technical service provider. Cornerstone processes personal data on behalf of the Operator in accordance with applicable data protection regulations. Further information on data processing can be found in the Privacy Policy.
3. Access and Use

Access to the LMS is restricted to the user groups mentioned above.
2.
Each user receives personalized login credentials, which must be kept confidential. Sharing login credentials with third parties is prohibited.
3.
The LMS may only be used for training purposes within the scope of professional activities.
4.
Content from the LMS may not be used for private or commercial purposes outside the company.
4. Training Content and Copyrights
1.
All content provided in the LMS (e.g., training materials, videos, tests) is the property of FR L'Osteria SE or has been provided by third parties.
2.
Reproduction, distribution, or publication of content without prior written permission is prohibited.
3.
Uploaded content must not infringe copyrights or intellectual property rights of third parties; the respective author is responsible for ensuring compliance.
5. Data Protection
1.
Personal data is processed in accordance with the Privacy Policy.
2.
Cornerstone processes the data on behalf of FR L'Osteria SE.
3.
Users are obliged to maintain data protection and the confidentiality of internal information.
4.
Training results may be shared with supervisors or authorized representatives of partner companies to document qualifications or fulfill legal training requirements.
5.
Access to the LMS automatically ends when the user leaves the company. The account will then be deactivated, and personal data will be deleted in accordance with the Privacy Policy.
6. Code of Conduct
1.
Users commit to acting respectfully and professionally.
2.
Any form of discriminatory, offensive, or inappropriate behavior is prohibited.
3.
When using interactive features (e.g., forums, comments, or chat), respectful communication and the protection of confidential information must be maintained.
4.
Violations may result in access suspension and further employment-related consequences.
7. Liability and Warranty
1.
FR L'Osteria SE does not guarantee the permanent availability or error-free operation of the LMS.
2.
Users are responsible for successfully completing their training sessions.
3.
FR L'Osteria SE is not liable for damages resulting from improper use. Liability for slight negligence is excluded. In cases of liability under the aforementioned terms or without fault, FR L'Osteria SE is only liable for typical and foreseeable damages. This limitation of liability does not apply to strict liability or damages resulting from injury to life, body, or health.
4.
The LMS may contain links to external content (e.g., YouTube videos or online courses). The Operator assumes no liability for content from external providers.
8. Changes to the Terms of Use
FR L'Osteria SE reserves the right to adjust these Terms of Use as needed. Changes will be communicated to users via the LMS or by email.
